Spoon & Sketch — Terms of Service

These Terms govern your use of the Spoon & Sketch app, the @spoonsketch_bot Telegram bot, and related services (together, the “Service”). By creating an account you agree to them. Please also read our Privacy Policy.

1. Who you're agreeing with

The Service is provided by Anhelina Ermakova, an individual developer based in Montreal, Quebec, Canada (“we”, the “Operator”). TODO: replace if you register a company Contact: privacy@spoonsketch.com. TODO: confirm mailbox + domain (.com vs .app)

2. What the Service is

Spoon & Sketch lets you collect recipes (manually, from links, photos, or via the Telegram bot), decorate them scrapbook-style, assemble cookbooks, export PDFs, and — when the feature is available — order professionally printed copies. Some features use AI; some require a paid subscription when offered (§8).

3. Eligibility and your account

You must be at least 13 years old (16 where the GDPR requires) to use the Service. You are responsible for the email account and devices used to access your account — sign-in links and connected services (Apple, Google, Telegram) act as your key. Tell us promptly if you suspect unauthorized access. One account per person; don't impersonate others.

4. Your content and license to us

You own what you create. Recipes, photos, drawings, dedications, and cookbooks you make remain yours. You grant us a limited, worldwide, non-exclusive license to host, store, reproduce, process (including AI processing you've enabled), display back to you, and — if you order printing — transmit your content to our print partner, solely to operate and provide the Service. This license ends when you delete the content or your account, except where retention is legally required (see Privacy Policy §7).

Recipes you import. When you import recipes from websites, books, or screenshots, you are responsible for ensuring your use is lawful. The Service is designed for personal, non-commercial use — your own digital cookbook and printed copies for yourself or as personal gifts. Recipe facts (ingredient lists, basic steps) are generally not protected by copyright, but creative text and photos from other authors may be. Don't sell printed books containing third-party content you don't have rights to.

5. Acceptable use

Don't use the Service to: store or share unlawful content; upload images that are sexually explicit, depict minors in any sexualized or exploitative context, or show graphic violence; infringe others' intellectual property; probe, overload, or disrupt the Service or circumvent usage limits and security measures; or resell or commercially exploit the Service without our written agreement. Uploaded images are automatically screened (see Privacy Policy §5); content that fails screening is deleted, and serious violations may be reported to authorities where the law requires.

6. AI features

AI features (recipe extraction, sticker matching) are optional and off until you enable them. AI output is generated automatically and may be inaccurate or incomplete — always verify extracted quantities, times, and especially any allergy- or safety-relevant details before cooking or sharing. AI features are subject to monthly usage limits that differ by plan; limits are shown in the app and may change with notice.

7. Free tier and changes to the Service

The free tier includes generous but limited monthly quotas for AI features and imports. We may adjust quotas, add or modify features, or discontinue parts of the Service. If we make a change that materially reduces what you've paid for, you'll be entitled to a pro-rated refund of the affected period.

8. Subscriptions and payments (when offered)

If and when paid plans are offered: purchases are made through Apple's App Store and are subject to Apple's payment terms. Subscriptions auto-renew until cancelled in your App Store account settings at least 24 hours before the period ends. Prices are shown before purchase and may change for future periods with notice. Refunds for App Store purchases are handled by Apple under their policies; statutory consumer rights (including EU 14-day withdrawal rules, where applicable) remain unaffected.

9. Printed books (when offered)

If and when book printing is available: print orders are produced and shipped by our partner Lulu xPress. By placing an order you confirm the preview is what you want printed and that you have the right to print its content (§4). Because each book is custom-made, orders generally cannot be cancelled once production starts, and returns are not accepted for reasons of taste — but we will reprint or refund orders that arrive damaged, defective, or misprinted: contact us within 30 days of delivery with photos. Delivery estimates are estimates; customs fees for international delivery are the recipient's responsibility. Statutory consumer rights remain unaffected. 10. Our intellectual property

The app, its design, built-in sticker artwork, fonts arrangement, and software are ours or our licensors' and are protected by IP laws. We grant you a personal, non-transferable license to use them within the Service — including in PDF exports and printed books made through the Service for personal use. You may not extract, redistribute, or sell the built-in artwork separately.

11. Termination

You can stop using the Service and delete your account at any time (Me → Delete account) — deletion is immediate and irreversible. We may suspend or terminate accounts that violate these Terms, with notice where practicable; in case of serious violations (e.g., §5 content rules) we may terminate immediately. Upon termination, your license under §10 ends; already-printed books are unaffected.

12. Disclaimers and liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages, loss of data caused by factors outside our control, or the accuracy of AI output and imported recipes (including allergen information). Our total liability for any claim is limited to the greater of the amounts you paid us in the 12 months preceding the claim or €50. Nothing in these Terms limits liability that cannot be limited by law (including for intent, gross negligence, or harm to life and health) or your statutory consumer rights in Canada, the EU, Ukraine, or elsewhere. If you are a consumer in Quebec, the Consumer Protection Act (Quebec) applies to you and certain limitations and waivers in this section do not apply to the extent it prohibits them.

13. Governing law and disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. If you are a consumer in the EU, Ukraine, or another jurisdiction with mandatory consumer-protection rules, you keep the protections of, and may bring proceedings in, your country of residence; Quebec consumers keep the venue and remedies the Consumer Protection Act guarantees. 14. App Store terms (Apple)

These Terms are between you and the Operator, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it (including product liability, regulatory compliance, or IP claims), which are our responsibility to the extent the law requires. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in an embargoed country and are not on any U.S. government restricted-party list.

15. Changes and contact
